In Queensland, under the How to Manage and Control Asbestos in the Workplace Code of Practice 2021, an asbestos register is mandatory for certain workplaces. Here's a breakdown of who needs one and the consequences of non-compliance:
Who Must Have an Asbestos Register?
According to the Code of Practice and the *Work Health and Safety Regulation 2011*:
Any workplace built before 31 December 2003 must have an asbestos register unless
No asbestos or asbestos-containing materials (ACMs) are identified.
There is written evidence that no asbestos is present.
The responsibility lies with the Person Conducting a Business or Undertaking (PCBU) who has management or control of the workplace. This includes:
Commercial building owners.
Property managers.
Tenants with control over the premises.
Facility managers or anyone overseeing maintenance or refurbishment.
What Must the Register Include?
- Location of asbestos or ACMs.
- Description of the materials.
- Condition and accessibility.
- Dates of identification and review.

Penalties for Non-Compliance
Failing to maintain an asbestos register is a breach of the Work Health and Safety Regulation 2011. As of current enforcement:
